Welcome to HookPDF. These Terms of Service ("Terms") govern your access to and use of the HookPDF API and related services ("Service"). By using our Service, you agree to be bound by these Terms.
1. Acceptance of Terms
By accessing or using our Service, you agree to be bound by these Terms and our Privacy Policy. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
2. Description of Service
HookPDF provides a PDF generation API that allows developers to:
- Create and manage HTML/CSS templates
- Generate PDFs programmatically via REST API
- Store and retrieve generated documents
- Access usage analytics and reporting
3. Account Registration
To use our Service, you must:
- Create an account with accurate and complete information
- Maintain the security of your API keys and credentials
- Promptly notify us of any unauthorized access
- Be at least 16 years of age
You are responsible for all activities that occur under your account.
4. Acceptable Use
You agree not to use the Service to:
- Generate illegal, harmful, or offensive content
- Infringe on intellectual property rights of others
- Distribute malware or engage in phishing
- Attempt to gain unauthorized access to our systems
- Overload or interfere with our infrastructure
- Resell or redistribute the Service without authorization
5. API Usage and Rate Limits
Your use of the API is subject to rate limits based on your subscription plan. Excessive usage beyond your plan limits may result in throttling or temporary suspension. We reserve the right to modify rate limits with reasonable notice.
6. Subscription and Payments
Certain features of the Service require a paid subscription:
- Subscriptions are billed monthly or annually in advance
- Prices are subject to change with 30 days notice
- Refunds are provided in accordance with our refund policy
- You are responsible for applicable taxes
7. Intellectual Property
Our Property: The Service, including its design, code, and documentation, is owned by HookPDF and protected by intellectual property laws.
Your Content: You retain ownership of templates and data you submit. By using the Service, you grant us a limited license to process your content solely to provide the Service.
8. Data Processing
We process your data in accordance with our Privacy Policy. For enterprise customers, we offer Data Processing Agreements (DPA) upon request.
9. Service Level Agreement
For paid plans, we commit to:
- 99.9% API uptime (Business plan and above)
- Response times as specified in your plan
- Service credits for qualifying downtime
10. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, HOOKPDF SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY.
Our total liability for any claims under these Terms shall not exceed the amount you paid us in the 12 months preceding the claim.
12. Indemnification
You agree to indemnify and hold harmless HookPDF and its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.
13. Termination
Either party may terminate this agreement:
- You may cancel your account at any time through your dashboard
- We may suspend or terminate your access for violation of these Terms
- Upon termination, your right to use the Service ceases immediately
14. Modifications to Terms
We may modify these Terms at any time. We will provide notice of material changes via email or through the Service. Continued use after changes constitutes acceptance of the modified Terms.
15. Governing Law
These Terms are governed by the laws of the State of California, USA, without regard to conflict of law principles. Any disputes shall be resolved in the courts of San Francisco County, California.
16. General Provisions
- Entire Agreement: These Terms constitute the entire agreement between you and HookPDF.
- Severability: If any provision is found unenforceable, the remaining provisions remain in effect.
- Waiver: Failure to enforce any right does not waive that right.
- Assignment: You may not assign these Terms without our consent.
